CC&Rs: Changes to 4.2

Based upon the 2019 budget, the current $100/year fee is insufficient to cover all budgetary needs to maintain all aspects of the community as requested by the residents. When initially set in 2006, the dues would have been $100 with an allowance in the CC&Rs to increase by 10% annually. Dues were not collected or increased, but at that pace, the 2019 annual fee would have been $345. This proposal is an increase to $200/year per resident address effective January 2020, maintaining the original option to increase no more than 10% per year. This will be a separate voting item at the annual meeting in May 2019.

Current:

4.2  4.1   Assessments. The following annual assessments shall be made on a per lot basis: $100.00 per year per lot. Such assessments may be increased ten percent (10%) per year by the Board of Directors of the association and up to fifteen percent (15%) per year upon the affirmative vote of 51% percent of the owners of lots in the subdivision. Such assessments shall be a lien upon the lot assessed. Any such lien may be foreclosed by the association and the lot owner shall be responsible for all costs and attorney’s fees incurred by the association in connection with such suit. No lot shall be entitled to more than one (1) vote, regardless of the number of owners. Annual assessments shall not apply to lots owned by the developer or unoccupied lots owned by others.

Any such lien may be foreclosed by the HOA and the lot owner shall be responsible for all costs and attorney’s fees incurred by the association in connection with such suit. No lot shall be entitled to more than one (1) vote, regardless of the number of owners.
